SmartFOP Public Offer Agreement and Terms of Use

User: an individual, sole proprietor, or business representative who creates a SmartFOP account, accepts this offer, and uses the service for their own work.

SmartFOP provides digital access to an online workspace for organizing sole proprietor work: counterparties, objects, services, invoices, acts, expenses, income, banking workflow, support, and basic work indicators.

The service is provided as software / an online service. SmartFOP does not sell or deliver physical goods.

Some modules may launch gradually. If a feature is not yet available or works in a limited mode, this is marked in the interface.

The user accepts this offer by creating an account, ticking the consent checkbox for the public offer agreement and privacy policy, and, for paid access, paying for the selected plan.

Acceptance means the user has read the terms, understands the service scope, and agrees to the rules for plans, payments, refunds, and personal data processing.

Electronic acceptance is treated as the practical consent required for using the service.

The user account is created using email and other data required for login, security, support, and workspace operation.

A sole proprietor business profile may be activated through registry lookup via OpenDataBot and ownership confirmation through Diia.Signature.

The user is responsible for activating their own business profile or having the right to act on behalf of the relevant sole proprietor or business.

Access to SmartFOP is provided according to the active plan: demo, free mode, or paid Standard or Premium plan.

Demo mode is intended for reviewing the service on prepared examples. Free mode has feature and quota limits.

Paid plans unlock regular work within the described features. Standard and Premium may differ by limits, module access, support, and future automation options.

The current plan price is shown to the user in UAH before payment.

Payments are processed online through a connected payment provider. SmartFOP does not store full bank card credentials.

After successful payment, access is activated automatically or after technical confirmation by the payment provider.

Payments on the website apply only to SmartFOP access and are not payments for third-party goods or services.

Refunds, plan changes, or transfer of unused balance are handled under the exchange and refund policy published at /en/refund.

If access was not activated due to a technical issue, the user may contact support to activate access or check whether a refund is possible.

To operate the service, SmartFOP processes account data, business profile data, documents, payments, support requests, and technical security data.

The detailed list of data, purposes, legal grounds, retention periods, user rights, and contact procedure are described in the Privacy Policy at /en/privacy.

By accepting this offer, the user also confirms that they have read the Privacy Policy and agree to data processing within the operation of SmartFOP.

The user is responsible for the correctness of seller details, client and counterparty data, document amounts, invoices, acts, work records, and files.

The user may not use SmartFOP for illegal activity, prohibited goods, fraud, infringement of third-party rights, or accepting payments for third parties through SmartFOP payment details.

If the user enters personal data of their clients, employees, or counterparties into SmartFOP, the user is responsible for the lawful collection and use of such data.

SmartFOP is not a bank, financial institution, payment system, acquirer, tax advisor, accounting company, or law firm.

Hints, templates, and automations are auxiliary. Final financial, tax, legal, and accounting decisions remain with the user.

SmartFOP is software / an online service, and the right to use it is provided to the user within the active plan.

The user does not receive property rights to the source code, design, database, brand elements, or other SmartFOP assets.

SmartFOP may update this agreement, plans, features, and service policies. The updated version is published on this page with an update date.

If changes materially affect paid access or data processing, we may additionally notify the user in the workspace or by email.

The parties will try to resolve disputes through support and information exchange. If a dispute cannot be settled voluntarily, it is resolved under the laws of Ukraine.
