Public offer and agreement examples
SmartFOP sells access to its own online service. The agreement is concluded as a public offer: the user registers, chooses a plan, and pays for service access.

Agreement template (public offer)
Provider: ФОП Вишневський Б.В., tax ID 3021914770, address: м. Тернопіль, Україна.
User: an individual or sole proprietor who creates a SmartFOP account and uses the service for their own work.
Subject: access to the SmartFOP online workspace for clients, counterparties, services, invoices, acts, plans, support, and basic work metrics.
Payment: the user chooses a plan, sees the price on the website, and pays online through the connected payment provider. After payment confirmation, access is activated automatically or after a technical payment check.
Term: access is provided for the paid period or within the active plan. If the plan ends or payment is not confirmed, access may be limited.
Refunds and plan changes: the exchange and refund policy published at /en/refund applies.
Rights to the service and software product
SmartFOP is a proprietary software product / online service that is sold to users as plan-based access.
ФОП Вишневський Б.В. has the right to provide paid access to SmartFOP. A confirmation letter about the right to sell access to the service can be provided to the payment provider on request.
What is not sold through SmartFOP
SmartFOP does not sell physical goods, financial services, loans, insurance, gambling products, crypto assets, or other high-risk goods or services.
SmartFOP does not accept payments for third parties and is not a marketplace. Payments on the website apply only to SmartFOP plan access.
Agreement example 1: STANDARD plan
The user creates a SmartFOP account, confirms contact details, and chooses the STANDARD plan.
After payment, the user gets access to STANDARD plan features: objects, clients, services, invoices, acts, and core workspace features.
The agreement is confirmed by account registration, acceptance of the terms, and successful online payment.
Agreement example 2: PREMIUM plan
The user chooses the PREMIUM plan for expanded access to SmartFOP features available under that plan.
After payment confirmation, the PREMIUM plan is activated in the workspace for the paid period.
If some features are still under development, they are clearly marked in the interface as temporarily unavailable or in progress.
How the agreement is concluded
The user creates an account, enters their details, chooses a plan, and starts payment.
Before payment, the user can see the plan price, payment recipient, terms of use, and exchange/refund policy.
After successful payment, the user gets service access, and payment details are stored in the workspace and with the payment provider.
